Terms of Service

These Terms are an agreement between you and Mind Magic ("we", "us", "our").

1. Acceptance

By creating an account or using Mind Magic, you agree to these Terms, our Privacy Policy, our Cancellation and Refund Policy, and our AI and Content Disclaimer. If you do not agree, do not use the service. You must be at least 18 years old.

2. What Mind Magic is

Mind Magic is a personal growth platform that includes the Mind Magic Map assessment, an AI companion (ME), the 21-Day Experience, coaching content, and optionally scheduled sessions with Dr. Carla. It is for reflection and personal development. It does not provide professional medical, mental health, legal, or financial advice. See the AI and Content Disclaimer.

3. Accounts

You are responsible for your account and for keeping your sign-in secure. Access is passwordless (a one-time code or link by email). You agree to provide accurate information and to keep it current. We may suspend or close accounts that violate these Terms.

4. Membership, billing, and cancellation

Paid purchases and memberships are billed through our payment processor, Stripe. Prices, billing periods, and any founding-member terms are shown at purchase. Your card statement will show a charge from Dr. Carla Burns. Memberships renew automatically until cancelled; you can cancel any time from your billing page, and cancellation and refunds are governed by our Cancellation and Refund Policy. You authorize us and Stripe to charge your payment method for the amounts you agree to.

5. Sessions with Dr. Carla

Some plans include, or let you purchase, one-on-one or group sessions. Scheduling, availability, rescheduling, and cancellation are described in the app and the Cancellation Policy. Sessions may be conducted over a third party (Zoom) and may be recorded; see the Privacy Policy and any consent notice shown at booking.

6. Your content and your data

You may enter personal reflections, assessment answers, journal entries, and messages to ME. You keep ownership of what you write. You grant us a license to store and process it to operate the service (for example, to generate your Map, to let ME respond, and to keep your records). We handle personal data as described in the Privacy Policy.

7. Our content and intellectual property

The Mind Magic Engine, the Mind Magic Map, the archetypes, the frameworks, ME's persona, the Experience content, and all related materials are the intellectual property of Mind Magic and its licensors. We grant you a personal, non-transferable, non-exclusive license to use them for your own personal growth while your account is active. You may not copy, resell, redistribute, scrape, or use them to build a competing product.

8. Acceptable use

Do not misuse the service: no unlawful, harmful, abusive, or infringing use; no attempts to break security, access other users' data, reverse engineer, or overload the system; no automated scraping; no using ME to generate unlawful content. We may remove content or suspend access for violations.

9. AI and no professional advice

ME and the Map are AI-assisted tools for reflection, not professional advice, and they can be wrong. You are responsible for your own decisions. If you are in crisis or need professional help, contact a qualified professional or local emergency services. The full AI and Content Disclaimer is part of these Terms.

10. Third party services

We rely on third parties, including Stripe for payments, Zoom for sessions, and our AI model providers. Your use of those features is also subject to their terms. We are not responsible for third party services.

11. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify us against claims arising from your misuse of the service or your violation of these Terms.

13. Changes and termination

We may update the service and these Terms. We will tell you about material changes, and continued use after that means you accept them. You may stop using the service at any time. We may suspend or end access as described in these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the United States and the state where we are established. If we have a dispute, we will first try in good faith to resolve it with you directly; contact us before anything else.
